Une chaîne américaine satirique, The Onion (‘American Finest news Source’) a réagi avec un spot publicitaire qui veut mettre les ados en garde contre les méfaits du tabagisme: ‘It’s gay to smoke’. Le Dr. Michael Gaines du Centre pour le contrôle et la prévention des maladies (Centre for Disease Control and Prevention) est venu expliquer pourquoi le tabagisme rend gay sur Onion News Network : ‘Si tu te mets à fumer, les gens vont se moquer de toi et raconter que tu te conduis comme tapette!"

Le spot met en scène deux élèves qui se rencontrent dans un couloir d'école et se retirent pour fumer une cigarette en cachette. Les images sont ambigues. Apparaît alors le texte: "Est-ce que tu fumes ou est-ce que tu es gay? Ne fume pas!"

Michael Gaines explique alors qu'il s'agit de s'adresser aux jeunes dans le langage qu'ils emploient. Le gouvernement a l'intention d'élargir la campagne et de placer des avertissements de ce type sur les paquets de cigarettes ou encore pour la prévention de la consommation des boissons alcoolisées.

Une satire certes, mais je doute de son efficacité, car j'imagine qu'elle peut engendrer l'effet inverse de l'effet désiré. On sait que les ados américains abusent de l'expression It's so gay pour se moquer d'un comportement, d'une attitude ou d'une mode. Cette satire ne va-t-elle pas renforcer l'homophobie ambiante dans les collèges américains, d'autant plus qu'elle est bien réalisée? Une arme à multiples tranchants."

House Votes to Expand Hate Crimes Definition

"WASHINGTON — The House voted Thursday to expand the definition of violent federal hate crimes to those committed because of a victim’s sexual orientation, a step that would extend new protection to lesbian, gay and transgender people.

Democrats hailed the vote of 281 to 146, which brought the measure to the brink of becoming law, as the culmination of a long push to curb violent expressions of bias like the 1998 murder of Matthew Shepard, a gay Wyoming college student.

“Left unchecked, crimes of this kind threaten to ruin the very fabric of America,” said Representative Susan A. Davis, Democrat of California, a leading supporter of the legislation.

Under current federal law, hate crimes that fall under federal jurisdiction are defined as those motivated by the victim’s race, color, religion or national origin.

The new measure would broaden the definition to include those committed because of gender, sexual orientation, gender identity or disability. It was approved by the House right before a weekend when gay rights will be a focus in Washington, with a march to the Capitol and a speech by President Obama to the Human Rights Campaign.

Republicans criticized the legislation, saying violent attacks were already illegal regardless of motive. They said the measure was an effort to create a class of “thought crimes” whose prosecution would require ascribing motivation to the attacker.

Representative John A. Boehner of Ohio, the House Republican leader, called the legislation radical social policy.

“The idea that we’re going to pass a law that’s going to add further charges to someone based on what they may have been thinking, I think is wrong,” Mr. Boehner said.

Republicans were also furious that the measure was attached to an essential $681 billion military policy bill, and accused Democrats of legislative blackmail.

Even some Republican members of the usually collegial House Armed Services Committee who helped write the broader legislation, which authorizes military pay, weapons programs and other necessities for the armed forces, opposed the bill in the end, solely because of the hate crimes provision.

“We believe this is a poison pill, poisonous enough that we refuse to be blackmailed into voting for a piece of social agenda that has no place in this bill,” said Representative Todd Akin of Missouri, a senior Republican member of the committee.

On the final vote, 237 Democrats were joined by 44 Republicans in support of the bill; 131 Republicans and 15 Democrats opposed it. The Democratic opponents were a mix of conservatives who were against the hate crimes provision and liberals opposed to Pentagon provisions.

The military bill has yet to be approved by the Senate. But the hate crimes provision has solid support there, and Senator John McCain of Arizona, the senior Republican on the Senate Armed Services Committee, said the overall bill outweighed his own objections to including the hate crimes measure.

Mr. Obama supports the hate crimes provision, though the White House has raised objections to elements of the bill related to military acquisitions. If signed into law, the hate crimes legislation would reflect the ability of Democrats to enact difficult measures with their increased majorities in Congress and a Democrat in the White House.

“Elections have consequences,” Mr. McCain said.

Similar hate crime provisions have passed the House and the Senate in previous years but have never been able to clear their final hurdles. Speaker Nancy Pelosi said Thursday that it was fitting that Congress was acting now, since next Monday is the 11th anniversary of Matthew Shepard’s killing. The hate crimes part of the bill is named for Mr. Shepard and James Byrd Jr., a black man killed in a race-based attack in Texas the same year.

The hate crimes legislation would give the federal government authority to prosecute violent crimes of antigay bias when local authorities failed to act. It would also allocate $5 million a year to the Justice Department to provide assistance to local communities in investigating hate crimes, a process that can sometimes strain police resources. And it would allow the department to assist in the inquiry and local prosecution if requested.

“The problem of crimes motivated by bias,” the measure says, “is sufficiently serious, widespread and interstate in nature as to warrant federal assistance to states, local jurisdictions and Indian tribes.”

Senator Carl Levin, the Michigan Democrat who heads the Armed Services Committee, said that the Federal Bureau of Investigation recorded reports of more than 77,000 hate crimes from 1998 through 2007 and that crimes based on sexual orientation were on an upward trend.

“The hate crimes act will hopefully deter people from being targeted for violent attacks because of the color of their skin or their religion, their disability, their gender or their sexual orientation, regardless of where the crime takes place,” he said.

But Representative Mike Pence of Indiana, the No. 3 House Republican, said the measure could inhibit freedom of speech and deter religious leaders from discussing their views on homosexuality for fear that those publicly expressed views might be linked to later assaults.

“It is just simply wrong,” Mr. Pence said, “to use a bill designed to support our troops to reverse the very freedoms for which they fight.”

Democrats, however, noted that the bill would specifically bar prosecution based on an individual’s expression of “racial, religious, political or other beliefs.” It also states that nothing in the measure should be “construed to diminish any rights under the First Amendment to the Constitution.”

The once higher than the rest former ex-gay Michael Johnston is the poster boy for "ex-gays" and their sullen movement to "convert gay men back on the straight and narrow path".

From BC Politics, As Southern Voice reports, Johnston, who is HIV-positive, admitted to having sex with men — allegedly without disclosing his seriopositive status. The news is also reported by Peter LaBarbera of the right-wing, anti-gay Concerned Women for America's department of Culture and Family, though Pete doesn't mention Michael by name. Ex-gay network Exodus International, however, does name names.

Why has Johnston never been prosecuted for willfull misconduct and possibly spreading HIV by having sex with men without their knowledge of his HIV status ?

Like this man in Texas as was reported back in May, McKinney, TX - A jury sentenced a man to 45 years in prison for knowingly infecting six women with the AIDS.

Philippe Padieu, described by his own lawyer as a "modern-day Casanova," shook his head and looked down when the decision was read yesterday. Jurors sentenced him to 45 years on five counts and 25 years on the sixth, to be served concurrently. Padieu had faced up to 99 years.

The Collin County jury convicted 53-year-old Padieu on Wednesday on six counts of aggravated assault with a deadly weapon. Since HIV is the virus that causes AIDS, prosecutors contended Padieu's bodily fluids were a deadly weapon. Padieu is a former martial arts instructor who continued to have unprotected sex after he tested positive for HIV in 2005.

Assistant District Attorney Lisa King in Collin County told jurors earlier yesterday that Padieu deserved a life sentence. But defense attorney Bennie House said Padieu may have made mistakes as a "modern-day Casanova," but did not intentionally spread the virus. He said a 20-year sentence would be fair. Jurors heard testimony was on Thursday in the punishment phase, including from women who described the harm that the HIV diagnosis had done them.

Or this man, A judge in Chicago in the US has sentenced a man to prison for concealing that he was a HIV patient while donating blood to a plasma collection center at Hammond.

Michael Ivy, 46, of East Chicago, pleaded guilty to selling blood contaminated with the HIV in September last year.

Blood plasma is the liquid component of blood, in which the blood cells are suspended. Plasma is a yellow colored liquid. Plasma is the largest single component of blood, making up about 55% of total blood volume. Blood plasma contains many vital proteins including fibrinogen, globulins and human serum albumin.

Pro-Tem Lake County Criminal Court Judge Robert Lewis on Friday ordered Ivy to serve a two-year sentence in a state prison and imposed a one-year probation on him. Ivy admitted he had been diagnosed in August 2002 with HIV. A doctor at St. Catherine Hospital in East Chicago confirmed the diagnosis in November 2002 and told Ivy he could never donate blood, plasma or tissue in the future.

Nevertheless, Ivy indicated to Bio-Blood, the Hammond collection center, last summer he wasn't infected with HIV. He checked the "no" box on a questionnaire that asked if he was HIV positive. Court records say Ivy donated blood three times last September before Bio-Blood tested the Sept. 13 specimen and found it HIV positive.

State law requires contaminated blood to be destroyed. According to researchers there is a 90% risk of HIV transmission through infected blood products which is higher than the risk from any other transmission means.

However there are those who object to criminalization of reckless transmission. They say that if there are many high-profile prosecutions, those who might be infected may be deterred from testing.

This may have serious public health implications.

Or this man in Canada, A Canadian man has been sentenced to 18 years in prison for knowingly exposing women to HIV, the virus that causes AIDS.

Carl Leone, 32, was convicted of 15 counts of aggravated assault, each earning him two to five years in jail, to be served consecutively for a total of 49 years.

But the judge reduced his sentence to 18 years to better reflect sentencing guidelines.
Superior Court Justice Joseph Quinn said at sentencing that Leone had committed a "despicable and selfish crime for five to 10 minutes of sexual gratification."

Leone was told in 1997 that he was HIV-positive, seven years before his arrest in June 2004.

Five of his victims are now HIV-positive.
